Terms

Between the Lines Website Terms 

  1. Before registering to participate on the Between the Lines site you must agree to these terms and conditions ("Terms"). The Terms are designed to ensure that your use of the Between the Lines site does not break any laws. The Between the Lines site is operated by the Tedd Noffs Foundation and any reference to Between the Lines includes the Tedd Noffs Foundation.
  2. By clicking the "I agree to the Between the Lines member Terms & Conditions" box, you agree to be bound by these Terms, as well as any other terms and conditions displayed on the Between the Lines site.
  3. You must not disclose your user name or password to any person. You must take all reasonable steps to keep your username and password secure so that it is not copied or used by any person. You must immediately notify Between the Lines if you become aware that another person has used your user name or password.
    Upon receipt of notification of use by another person, Between the Lines will deactivate your user name and password, and you will be required to create a new user name and password.
  4. You must not submit, post or upload any material to the Between the Lines site which:
    (a) is inappropriate, offensive or contrary to any applicable laws or standards. This includes, without limitation, material which:
            (i)     is obscene or indecent, depicts violence, sexual activity or pornography; or contains  instructions in crime or drug use; or
            (ii)    defames, harasses, menaces, threatens, abuses, offends or embarrasses any person;
    (b) infringes the copyright, moral rights, confidentiality rights or intellectual property rights of any person, for example, by reproducing songs, poems, articles, logos, trade marks, pictures, photos, music or other material that is not owned by you (or which you do not have a license to reproduce on the site);
    (c) infringes any of our rights or the rights of any third person including privacy rights;
    (d) breaches any laws, regulations, standards or codes as enacted, modified or updated from time to time, including, without limitation, attempts to solicit or obtain illegal drugs;
    (e) impersonates any person or suggests a connection to a group or organisation which is misleading;
    (f) advocates the use of force or violence towards any person;
    (g) encourages, endorses, approves or recommends the performance of dangerous or illegal acts; or
    (h) contains a virus or other code that has harmful or destructive properties.
  5. Subject to this clause 5, Between the Lines may in its discretion access, monitor and review all  content or material which you submit to the site.  You grant Between the Lines a perpetual, royalty free, non-exclusive, irrevocable, worldwide licence (with a right to sub-license to our authorised nominees) to use, modify, copy, distribute, transmit, reproduce, publish, display and broadcast that material or any part of it on this site as well as in any promotional or communication activities of Between the Lines conducted in Australia or overseas.
  6. Between the Lines may, at any time, without notice to you, filter, remove or refuse to post files, content or other material which it considers in its discretion to be in breach of clause 4 of the Terms.  Between the Lines may also by written notification terminate your registration and/or suspend your access to the forum sections of the site if you breach the Terms.
  7. You are solely responsible for any content or material which you post or upload on the site, or which is posted by another person using your user name or password. Between the Lines excludes all liability (to the extent permitted by law) for any loss, damage or expense suffered by you or claims made against you arising from content or material which you post or upload on the site or which is posted by another person (whether using your user name or password or otherwise).
  8. Between the Lines will take reasonable steps to ensure the security and confidentiality of material which  you post or upload onto the site. However, we cannot guarantee against any loss, damage, alteration or misuse of the content or material, and will not be responsible for any harm that you or any other  person may suffer in connection with any loss, damage, alteration or misuse of material posted or uploaded onto the site.
  9. By submitting content or materials to this site, you consent to Between the Lines exercising all rights in respect of such content or materials as are set out in these Terms even if the exercise of such rights would, but for this consent, infringe any moral rights that you may have in such content or materials.
  10. Between the Lines is legally obligated to disclose to the relevant law enforcement authorities any content or material submitted to this site that creates knowledge or belief of the reader that a serious indictable offence has been committed and which Between the Lines believes may be of assistance to law enforcement authorities.  Among other things, a serious indictable offence includes:
    (a) supplying or knowingly taking part in the supply of a prohibited drug;
    (b) planning or preparing to supply or take part in the supply of a prohibited drug;
    (c) possessing an amount that is equal to or more than the traffickable quantity of a prohibited drug and the person possessing that quantity of prohibited drug cannot prove either that the drug is in their possession for a reason other than supply or that they are in possession of it in accordance with a prescription; and  
    (d) supplying a substance (that is not a prohibited drug) that is falsely represented as being a prohibited drug.
  11. Between the Lines may impose limits on the size of files uploaded by users. Between the Lines may also filter, remove or refuse to post files which interfere with the technical operations of the Between the Lines network including files which threaten to overload or crash a system.

  13. The Terms, your use of the site and any disputes between you and Between the Lines will be governed by and construed in accordance with the laws of the State of New South Wales. You are solely responsible for ensuring that your use of the site is not prohibited and complies with your local laws.
  14. We may vary any of the Terms at any time by placing a notice on the site advising that the Terms have changed. You will be deemed to have accepted and agreed to the revised Terms if you continue to use the site after notice of the revised Terms has been placed on the site.
